Deputy District Attorney for Perez Zeledon, Edgar Ramirez told reporters on Monday that prosecutors intend to appeal the Monday acquittal of Ann Patton, the US woman who stood accused of killing her wealthy husband John Felix Bender on January 8th, 2010.

In what marked the end of her third murder trial, a three-judge panel unanimously ruled on Monday morning to acquit Patton.

If the appeal is accepted, Patton could potentially face a fourth trial for murder. Costa Rica has no prohibition on so-called “double jeopardy.”

Ramirez told reporters that there is “no doubt” that Patton murdered her husband, and insisted evidence proves that Patton shot her husband while he slept.

Ramirez said that prosecutors would begin preparing an appeal, which will be filed in the coming weeks.

Speaking to ICR News throughout her previous trials, Patton, who says her husband’s death was a suicide, has always maintained her innocence.
